A guide to securing parental rights for LGBTQ+ parents in Texas

On Behalf of Jeremy J. Poet Law Firm, PLLC | Oct 8, 2025 | Family Law

If you are an LGBTQ+ couple in Texas adopting or already have adopted a child, you may need to secure legal recognition of both parents. You and your partner may encounter legal hurdles when trying to confirm parental roles.

By completing each required action, you can gain legal parentage, complete court procedures and over time secure your parental rights.

Legal pathways for establishing and protecting parental status

Texas law permits same-sex couples to adopt. A biological link by itself may not give a non-birth parent parental rights. Second-parent adoption can grant the non-birth parent legal status while keeping the birth parent’s rights intact.

If you are married, both spouses can appear on a birth certificate when a child is born during the marriage. A court order of adoption generally provides stronger protection that applies across states. Begin the adoption or legal process soon after the child’s birth. This step can help create a documented legal relationship between you and your child.

Essential documentation and court procedures for full recognition

Courts typically need specific documents before they grant parental rights. You may submit petitions, affidavits and evidence of your ongoing parental role. Texas law sometimes allows courts to waive an adoption evaluation for stepparent adoptions. This can include second-parent cases when you are married.

After the court issues an order, you can update the Texas birth certificate to list both parents. Complete paperwork can reduce delays and support recognition with schools and agencies.

Practical safeguards to maintain and enforce parental rights

You can also strengthen your legal position beyond adoption or court orders by considering these actions:

  • Maintain detailed records of caregiving, financial support and joint decision-making for your child
  • Update wills, medical powers of attorney and guardianship designations to reflect your parental arrangement
  • Keep identity documents current to avoid conflicts in schools, health care or travel

These steps may help build a clear record of your parental role. They could support your legal standing if another parent, an agency or an institution questions your parental rights. If this occurs, consider reaching out to an attorney who focuses on LGBTQ+ family law in Texas to review your documents and advise on possible remedies. Taking this step can help you respond quickly and show the evidence needed to protect your relationship with your child.

Securing stability and recognition for your family

Securing parental rights in Texas may take several steps, but each action strengthens your legal relationship with your child. Completing court processes and keeping documents up to date can help reduce future disputes and provide your family with greater security.
